Links to other sites

Some pages of the site may contain links to other websites, not maintained by the operator of the site, which does not share personal information with such sites. (6) The operator of the site is not responsible for the content, security, or privacy measures employed by other sites and expressly disclaims all liability.

Notes

(1) According to the general provision of the Italian Privacy Authority of 8 May 2014, if the operator of the site, or third parties, use profiling cookies entered by the operator of the site, a «short» preliminary disclosure must be immediately provided in a pop-up banner on the home page (or on other pages from which the user can access the site) that summarizes some basic information and explicitly requests consent for profiling purposes. The information to be included in the «short» disclosure is:

  1. a) a statement that the site operator uses profiling cookies;
  2. b) if the site also allows the use of such profiling cookies by third parties;
  3. c) a link to the “extended” disclosure;
  4. d) a statement that the installation of any (all or some) cookies can be prevented through the extended disclosure;
  1. e) a statement that continuing to navigate implies the necessary consent to profiling. The Privacy

Authority has prepared a model form for «short” disclosure . Adding technical cookies to track the consent given by the user to profiling cookies by continuing to navigate allows suppressing the redisplay of the «short» disclosure during subsequent visits by the same user. The requirements of the mandatory general provision must be implemented by 3 June 2015.

(2) The code identifies these cookies (not subject to prior notification or consent) in cookies «intended solely for the transmission of a communication over an electronic communications network, or as strictly necessary for the provider of an information society service explicitly requested by the contracting party or user to provide the service» (Article 122, paragraph 1, of the privacy Code).

(3) If you use Google analytics service, following acceptance of the related terms and conditions of use, and since the cookies installed are not used directly by the operator of the site and, thus, are not considered «technical» cookies, it is necessary to inform users that: “the data acquired through Google Analytics can also be used by Google according to its terms of service”. According to the clarification of the Italian Privacy Authority of 5 June 2015, analytics cookies do not require the user’s prior notification or consent, provided that two specific conditions are met: a) the operator of the site adopts tools that reduce the identifying power of the analytics cookies (for example, by masking portions of the IP address); b) third parties are contractually obligated to use cookies only for the supply of services and not to «cross-match them» with other user information. Otherwise, it becomes necessary to insert a «short» disclosure in a pop-up banner, indicating the presence of cookies from Google Analytics.

(4) Profiling cookies are those that cause «the storage of information in the terminal device of a contracting party or user or access to information already store; they are only allowed on condition that the contracting party or the user have given their consent after being informed by the simplified methods referred to in Article 13, paragraph 3”. Therefore, the use of profiling cookies by the operator of the site requires, in addition to disclosure to the user (Article 13 of the Privacy Code, the omission of which is punishable under Article 161) also the acquisition of consent (Article 23 of the Code): in the case of failure to acquire consent, the violation is punishable (Article 162-bis of the Code). In addition, the presence of such profiling cookies also imposes an obligation on the operator to give prior notification of such processing to the Italian Privacy Authority (Article 37, paragraph 1d of the Privacy Code; omission is punishable under Article 163 of the Code).

(5) The general provision on cookies (point 4.2) requires that the «extended» disclosure provide links to the disclosures and consents of the third parties with which the site manager has entered into agreements, or the sites of intermediaries (such as advertising agencies) between the operator of the site and third parties. For any use of Google Analytics, there must be a link to the specific Google information page: www.google.it/policies/privacy/partners/.

(6) Banner ads and links to social networks, if simple links to third party sites (without installation of profiling cookies) do not require disclosure or consent. It would, however, be a good idea to give users generic information about this situation of simple links to other sites as well.
